Indian patent office has kept open to the public the Draft Rules patents (Amendment) Rules 2010 for any objection or suggestion. This amendment is mainly regarding the rules related to international filing at indian patent office and as the indian patent office will act as international search authority and preliminary examining authority for PCT application.

A huge backlog at indian patent office
Due to increase in filing of patent application from india as well from foreign countries, the backlog at indian patent office is increasing day by day. Presently the staff is very less to handle the inflow of patent application at all the indian patent office branches. However indian patent office has already given notification for recruitment of patent examiner and the exam for the same is going to be held on 2nd January, 2011 at various centres. Hope this will increase the strength of patent examiners at indian patent office and reduce the pending backlog.

Troikaa Pharma's Dynapar AQ extends patent portfolio
Troikaa Pharmaceuticals Ltd, an Ahmedabad-based pharmaceutical firm has been granted a patent this week for ‘Dynapar AQ’, a painkiller injection, in the Commonwealth of Independent States also known as the CIS block. The CIS countries include Ukraine, Kazakhastan, Belarus, Uzbekistan, Turkmenistan, Kyrgystan, Russia among others.
Last year Australia had granted a patent for Dynapar AQ to Troikaa Pharma; Australia being the first regulated markets for this drug. Similar patent applications are pending in the United States, EU and Canada.
Diclofenac injections are used for treating painful inflammatory conditions. Dynapar AQ is a high concentration and low viscosity injection of diclofenac sodium which delivers the full curative dose of diclofenac in just one milliliter injection. It is the only diclofenac injection available in PFS (pre-filled syringe) form and causes minor pain. It has a 40 per cent market share in Diclofenac injections being sold in India

NGOs, patient groups alert PMO not to act on behest of OPPI on patent issues
A large number of patient groups, groups working on public health and HIV, public interest organizations, experts and concerned citizens have demanded to the Prime Minister's Office (PMO) to immediately withdraw the biased and one-sided notes which the PMO had reportedly circulated to the union ministries of commerce, health, legal affairs and chemicals at the urging of OPPI to amend key public health safeguards in the Patents Act including Section 3(d), and asking for patent linkages and data exclusivity.
The NGOs and experts in a letter to the PMO said that the OPPIs’ demands are contrary to the Indian Constitution and Indian law, and will severely undermine access and availability of affordable quality generic medicines. “We regret that the PMO circulated this biased note without any prior investigation into the legitimacy of the claims or the fact that several demands made by OPPI and US and European Pharmaceutical companies are either sub-judice or have been rejected by Indian Courts keeping in mind the Government’s constitutional obligations of life & health”, the letter said.

PH Kurian statement at John F Welch Technology Centre
The Controller General of Patents, Designs and Trademarks PH Kurian had visited one-day event which was held by GE Technology Centre to observe the 10 years of IP creation at the John F Welch Technology Centre
After joining at his post, Mr. Kurian has done a very wonderful job to transfer the patent office form hard copies to online stream. Mr. Kurian has said that the key task of granting a patent is to allow people to have access to the latest technology or drug. He also announced the development of a software to publish the entire details of the Indian patented products, which will give a broad overview on whether it is functional or not.
Mr. Kurian has explained at the forum about the objective of patent office is to provide the public the complete information about the valid patents granted in India. "We are here not to pressurize the patentee but to encourage them in coming out with innovative findings. Patent law is not to incentivise the industry but to make available a novel discovery or invention that would help end-user to improve the quality of life", said Kurian.
The data 'on working of patents' is being compiled and will soon be made available online for the public to know the validity of the patent. Of the 33,000 applicants so far, 24,500 have furnished the information on working of patents and 30 percent are yet to make submissions, stated Kurian.
